Article 1 – Definitions

The following definitions apply to these General Terms and Conditions:

Withdrawal Period: The time frame in which the customer may exercise their right to cancel or return a purchase, as permitted under Canadian consumer protection laws.

Consumer: A natural person acting for personal, non-commercial purposes, who enters into a distance contract with Marlyn’s Boutique Yorkville.

Continuous Contract: A distance agreement relating to a recurring or ongoing supply of products and/or services.

Right of Withdrawal / Cooling-Off Right: The consumer’s right to return a product within the applicable withdrawal period under Canadian law.

Business: Marlyn’s Boutique Yorkville – offering products to consumers through distance sales.

Distance Contract: A contract concluded between the consumer and Marlyn’s Boutique Yorkville using online communication methods.

Payment Reporting Obligations: The reporting of certain payment information to Canadian authorities where required by Canadian federal or provincial law.

Article 3 – Scope of Application

These terms apply to all offers and agreements between the consumer and Marlyn’s Boutique Yorkville. Before any agreement is concluded, these terms will be made electronically available to the consumer.

Article 4 – Offers

All offers on the website are non-binding. Marlyn’s Boutique Yorkville reserves the right to update or change prices and availability at any time. Prices listed include the product price and, where indicated, shipping costs.

Import duties, taxes, customs clearance fees, and any courier surcharges are the customer’s responsibility unless explicitly stated otherwise.

Article 5 – Agreement

Once an order has been placed and payment has been confirmed, the agreement becomes binding. From this moment onward, orders cannot be cancelled under any circumstances.

Customers must wait until the package has been delivered before submitting any return request, in accordance with Article 6 and 6a.

For clarity, cancellations are not possible after payment confirmation. Refer to the “Order Cancellations” section of our Return Policy.

Article 6 – Right of Withdrawal

Consumers have the right to withdraw from their order within 14 days of receiving the product, consistent with applicable Canadian consumer protection guidelines. No reason is required for the return. Return shipping costs are the consumer’s responsibility.

Article 6a – Exclusions from the Right of Withdrawal

Items discounted by 40% or more are final sale and cannot be returned, refunded, or exchanged.

Sale items with a discount of less than 40% may be returned in accordance with our Return Policy.

Article 7 – Costs in Case of Withdrawal

Upon withdrawal, Marlyn’s Boutique Yorkville will refund the consumer within 14 days after receiving the returned item, provided it is received in its original condition and packaging.

For all eligible returns, a CAD $15 restocking fee per item applies to cover inspection and handling costs.

Article 8 – Customs and Taxes

The consumer is responsible for any applicable customs fees, import duties, provincial or federal taxes, and compliance with local regulations. Marlyn’s Boutique Yorkville is not the official importer of record for international orders.

Any costs incurred during customs processing, including additional courier or brokerage charges, are the sole responsibility of the customer.

We provide appropriate shipping documentation, but we cannot guarantee customs clearance or compliance with local regulations. Please check your country’s import policies before ordering.

Article 9 – Payment Reporting Compliance

Marlyn’s Boutique Yorkville complies with any applicable Canadian federal or provincial laws requiring payment service providers or businesses to report certain types of transaction data to Canadian authorities.

Article 10 – Compliance and Warranty

All items sold are expected to meet the descriptions and standards presented. If a product arrives defective or not as expected, the customer must notify us in writing within 14 days of delivery.

Returns must be in original packaging and in unused condition.

Article 11 – Delivery

Orders are normally delivered within 30 days. If a delay occurs, the customer will be informed within 14 days after placing the order.

The customer is responsible for handling import and customs formalities when applicable. Marlyn’s Boutique Yorkville is not liable for customs delays or related costs. Failure to comply with customs procedures is not grounds for cancellation or refund.

Article 12 – Complaint Resolution

Complaints must be submitted via email within 7 days of discovering the issue. We aim to respond within 14 days. If more time is required, the customer will be informed with a revised resolution timeline.

Article 13 – Governing Law and Disputes

These Terms and Conditions are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

Any disputes will first be addressed through communication and attempted resolution. If a resolution cannot be reached, disputes will be handled by the competent courts of Ontario, Canada.

Nothing in these Terms limits your statutory rights under applicable Canadian consumer protection legislation.
